Safety and public order during the state of emergency in the Polish view

Abstract

Securing public safety and order is the most important task of the state. In the event of a threat
to the constitutional system of the state, the security of citizens or the public order, the President,
at the motion of the Council of Ministers, may introduce a state of emergency for a definite period
of time in a part or in the entire territory of the state. In the case of a state of emergency, which is
introduced when the security of the state, the safety of citizens or the public order is threatened, the
priority is to restore the proper functioning of state institutions and to prevent the specified danger.
Only a reasonable use of statutory powers may result in not exceeding the justified level of restrictions
of rights and freedoms, that will be acceptable in connection with the extraordinary situation
caused by the circumstances that justified the imposition of a state of emergency.
