Abstract

Security is an important element of operating of the individual and the whole society. The state
should provide every citizen with protection through its numerous institutions. It is connected
with protecting its basic rights as well as with the duties of enforcing obligations. Citizens and
foreigners who are staying in the territory of the Republic of Poland have to obey implemented
regulations. Realising the national security policy, the Border Guard fulfill its statutory duties
while serving at border crossings points, on road routes, airports and in Border Centers for Foreigners.
Foreigners willing to stay in Poland must meet specific requirements and procedures. Not
following the applicable laws results in detention and placement in Centers For Foreigners. The Act on Foreigners provides for the right to detain an foreigner who is subject to circumstances
justifying the issuance of the decision on departure or who evades performing the obligations set
out in the expulsion decision. Whereas the Act of 13 June 2003 on granting protection to a foreigner
on the territory of the Republic of Poland limits the legal possibility of detaining the person
applying for protection.
